By downloading, installing, or using the PocketTuner mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PocketTuner is a mobile application designed to help sim racing enthusiasts optimize their car setups in various racing games. The App includes features such as:

• Car tuning tools and setup customization
• AI-powered tuning assistance (Pro subscription required)
• Public chat functionality for community interaction
• Setup saving and synchronization across devices
• Support for multiple racing games including Forza Motorsport, Gran Turismo, and others
• Social posting and image sharing capabilities
• Commenting system for community interaction
• Profile customization with profile pictures
• Content discovery and social engagement features

3. Pro Subscription Service

3.1 Subscription Features

PocketTuner Pro is a premium subscription service that provides access to advanced features including:

• AI Tuning Assistant with personalized recommendations
• Unlimited custom setup saves
• Early access to new features

3.2 Pricing and Billing

• Monthly Subscription: $4.99 USD per month
• Subscription fees are charged monthly to your chosen payment method
• Prices may vary by region and are subject to applicable taxes
• Subscription automatically renews unless cancelled before the renewal date
• We reserve the right to change subscription prices with 30 days advance notice

3.3 Free Trial

We may offer free trial periods for Pro subscriptions. During the trial period, you have access to all Pro features. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

3.4 Cancellation and Refunds

• You may cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Upon cancellation, you retain access to Pro features until the end of the paid period
• Refund requests are handled according to the app store's refund policy

4. User Accounts and Registration

• You may need to create an account to access certain features
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information when creating an account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

5. Community Guidelines and Chat Conduct

When using the public chat feature, you agree to:

• Keep conversations related to sim racing and appropriate for all ages
• Respect other users and maintain a positive community atmosphere
• Not share personal information such as real names, addresses, or contact details
• Not engage in harassment, bullying, or discriminatory behavior
• Not spam, advertise, or promote unrelated content
• Not share inappropriate, offensive, or illegal content
• Report inappropriate behavior using our in-app reporting features

Violations may result in temporary or permanent suspension from chat features or the entire App.

6. Social Features and Content Guidelines

6.1 User-Generated Content

When using social features (posts, images, comments, profile pictures), you agree to:

• Only post content that you own or have permission to share
• Not post copyrighted material without proper authorization
• Keep content appropriate and relevant to sim racing
• Not post spam, duplicate content, or misleading information
• Respect other users' privacy and not share personal information without consent
• Not post content that violates any laws or regulations

6.2 Image and Media Guidelines

• Images must be appropriate for all ages and relevant to sim racing
• No nudity, violence, or graphic content
• No images containing personal information (license plates, addresses, etc.)
• Profile pictures should represent you appropriately and not impersonate others
• We may compress, resize, or optimize uploaded images for performance
• We reserve the right to remove images that violate these guidelines

6.3 Comments and Interactions

• Comments should be constructive and relevant to the post
• No harassment, bullying, or personal attacks in comments
• Respect different opinions and racing styles
• Report inappropriate comments using our reporting system
• You are responsible for all comments made from your account

6.4 Content Moderation

• All user-generated content is subject to moderation
• We use both automated systems and human review to moderate content
• Content that violates guidelines may be removed without notice
• Repeated violations may result in account suspension or termination
• We reserve the right to remove any content at our discretion

7. AI Features and Content

• AI tuning recommendations are provided for educational and entertainment purposes
• AI-generated content may not always be accurate or suitable for all situations
• You use AI recommendations at your own risk and discretion
• We do not guarantee improved performance from following AI suggestions
• AI features require an active Pro subscription

8. User-Generated Content and Intellectual Property

8.1 Your Content Rights

• You retain ownership of all content you create (posts, images, comments, setups)
• You grant us a worldwide, non-exclusive license to use, display, and distribute your content within the App
• This license includes the right to modify content for technical purposes (compression, formatting, etc.)
• You can revoke this license by deleting your content or closing your account
• You represent that you have all necessary rights to the content you post

8.2 Content Responsibilities

• You are solely responsible for all content you post or upload
• You must ensure your content doesn't infringe on others' intellectual property rights
• You agree to indemnify us against any claims related to your content
• We are not responsible for user-generated content or its accuracy

8.3 Prohibited Content

You may not post content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malicious code or harmful elements
• Is offensive, inappropriate, or violates community standards
• Contains personal information of others without consent
• Promotes illegal activities or violates platform policies
• Is spam, duplicate, or misleading content

9. Intellectual Property

• The App and its content are protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, or reverse engineer the App
• Game names and trademarks are property of their respective owners
• We respect intellectual property rights and expect users to do the same

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of profits, or business interruption.

13. Termination

• You may stop using the App at any time
• We may suspend or terminate your access for violations of these Terms
• Upon termination, your right to use the App ceases immediately
• Certain provisions of these Terms survive termination

14. Updates and Modifications

• We may update the App and these Terms from time to time
• Significant changes will be communicated through the App or via email
• Continued use of the App after changes constitutes acceptance of new Terms
• You should review these Terms periodically for updates

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where PocketTuner is operated, without regard to conflict of law principles.
